- For the purpose of these terms and conditions "We", "Us" and "Our" means Blue Anchor Leisure Limited, Seaways, Roman Bank, Winthorpe, Lincolnshire PE25 1HZ, United Kingdom. "You", or “Your" refers to You, the customer and user of the Privilege Card Service. By registering for a privilege card, or applying for a Privilege offer, you are deemed to have accepted these terms and conditions.
- The Privilege Card Scheme is a loyalty scheme brought to You by Us. The Scheme is free of charge and provided to you as a benefit of being a holiday homeowner of Blue Anchor Leisure.
- Applications for the Privilege Card Scheme are only open to our holiday homeowners aged 18 years or over who have, purchased a holiday home with us and are registered owners of the holiday home. Additional card holders do not have to own a holiday home with us and are not required to be 18 years or over, it is the choice of the holiday homeowner to select the additional seven card holders. Additional card holders must be added within the initial application by the homeowner.
- You hereby warrant that all information submitted by You to Us is accurate and current. We reserve the right to verify the eligibility of holiday homeowners.
- You agree that the information supplied by You to Us may be used by Blue Anchor Leisure Ltd or our staff for the following purposes which shall include but are not limited to: contacting you regarding the scheme and from time to time evaluating if we can improve the scheme for owners. Your information will be treated in accordance with Blue Anchor Leisure’s Privacy Policy, which can be viewed at https://blueanchorleisure.co.uk/privacy-policy.
- We reserve the right to make any changes to the Scheme or to discontinue any aspect or feature. Blue Anchor Leisure may modify or withdraw Privilege Card Offers or elements of it at any time.
- We reserve the right to make changes to these terms and conditions at any time.
- Any use of the scheme by You is on an "as is" and an "as available" basis. You agree and accept that Privilege is not a fault-free Service and is for Your own personal use and shall not be used for commercial purposes. Any use of the Privilege Card Scheme is entirely at Your own risk and in no event shall we be liable for any indirect, incidental or consequential damages including without limitation loss of income, data or other information as a result of the use of the Privilege Card Scheme.
- Privilege Card offers are subject to availability and may only be available while stocks last. We'll not be responsible if Your application for a Privilege Card offer is incomplete, lost or not received.
- Links to third party websites and companies may appear on the service. Such third-party websites are not the responsibility of Blue Anchor Leisure Ltd and We accept no responsibility for the availability, suitability, reliability or content of such third-party websites.
- Components of the Privilege Card Scheme are supplied to Us by third parties, and We cannot be held responsible for and do not accept any liability, either express or implied as to such components, including but not limited to their accuracy, relevance or quality.
- You acknowledge and agree that We are not responsible for the availability of any third-party products and services or what You access through the Privilege Card Scheme. We shall not be held responsible or liable for any content, advertising, products or services available from such third parties. Any dealings between You and any third-party advertisers or merchants found on or via the Privilege Card Scheme, including payment for and delivery of products, services and any other terms, conditions, warranties or representations associated with such dealings, are made between You and the relevant advertiser or merchant. Therefore, we are not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings.
- Blue Anchor Leisure Ltd accepts no liability or responsibility for any of the third-party bookings, products and services provided by third party suppliers. The third-party suppliers will be supplying products and services to You on their own standard terms and conditions. Please note that third party offers may be withdrawn or amended at any time.
- Privilege Cards and features within the Privilege Card Scheme may also be protected by intellectual property rights belonging to Blue Anchor Leisure Ltd, its licensors or to third parties. No licence is granted to You in respect of any such rights, except to the extent required for Your personal use of the Privilege Card Scheme in accordance with these terms and conditions. Blue Anchor Leisure Ltd and any other Blue Anchor Leisure product or service name are trademarks of Blue Anchor Leisure and You shall not be entitled to reproduce such marks without our prior written consent.
- All Blue Anchor Leisure Owner Privilege Cards & Family or Friends Privilege Cards remain the property of Blue Anchor Leisure Limited and cannot be sold to a third party.
- We will not hesitate to cancel All Blue Anchor Leisure Privilege Cards and Owner Friends & Family Privilege cards on any owners account if we believe that the use on your account breaches any of the following terms and conditions:
- Use of Blue Anchor Leisure Privilege Cards and Owner Friends & Family Privilege cards by anyone other than the authorised cardholder.
- The sale of any Blue Anchor Leisure Privilege Cards and Owner Friends & Family Privilege cards.
- Using Blue Anchor Leisure Privilege Cards and Owner Friends & Family Privilege cards for profiteering activities.
- Giving Blue Anchor Leisure Privilege Cards and Owner Friends & Family Privilege cards to a private letting holiday guest.
- Abuse or misuse of Blue Anchor Leisure Privilege Cards and Owner Friends & Family Privilege cards may result in the permanent withdrawal of all Blue Anchor Leisure privilege Cards for both owners and friends & family on an owners account.
- These terms and conditions are governed by English Law and You, and we submit to the non-exclusive jurisdiction of the English Courts.
